From experience - I had someone pull out from the kerb into the side of my car a few years ago without indicating, an old coffin dodger, mind, i'm nearly there now. He contested what happened saying I was racing to work, which I wasn't, I do flexy, then they offered 50/50 which I declined and after 18 months they decided we'd go to court.
So I met my solicitor and advised him what happened, and he said we had to be careful because the judge we had today quite often found in favour of (I can't remember which he said as it was a while ago now, old duffer/defendant, something like that)
Anyway, there was I, green as can be, first time in a court totally reliant on my brief, and I have to say I have never been so disappointed in someone in my life. I sat next to him thinking 'he's going to challenge this soon' 'he's going to say x or y or z' but nothing. Before I could realise what was going on we was sat outside and he was saying 'well, you can appeal against the decision if you want' yeah right and use you as my brief, I don't think so.
Just be careful, I learnt from experience, it's a tough call, take 75% or risk it ???
But if you do go to court, don't be afraid to speak up !
