Scorchio, they are the ones who make themselves look bad by their abysmal service & offensive attitude to customers who have handed over their hard earned in good faith.

There used (it was deleted after they threatened Dan with legal action. I'm damn sure if Dan had the spare cash/time to have been sending Solicitors letters back & forth, then he'd have told them to ram it, but there you go..)to be a thread on here where someone had posted their exchange of emails with this bunch of clowns. He'd handed over a big wedge for his bling that never materialised. It made for very uncomfortable reading. Their attitude to him was offhand at best & often offensive. Seems they haven't changed at all.

This kind of thing makes my blood boil. I used to be a customer service officer for a catalogue company, and if I'd have responded to genuine concerns like they do, I'd have been sacked, and rightly so.

I heard all the stories about them when I first got my 848, but took a chance and used them. I have probably ordered 2000 pounds worth (maybe more) of stuff with them over about 5 orders. They were late with one item, but it was clear on the website when I ordered that they were waiting for that item to come into stock. I can honestly say I am perfectly happy with them and would recommend them to a friend.

Who the hell am I???!

Sorry to barge in this being my first few posts but just couldn't sit behind the computer and watch someone give eMoto any money! They are a bunch of sheisters! Yes, Emoto you are.

My husband who buys huge amounts of unashamedly bling things paid them money for something that still hadn't appeared 6 weeks later. Every single email they sent back was horribly rude and I mean, seriously rude and petulant and they even said they had refunded the money when my husband cancelled the order. They hadn't at all and it was only when the credit card company got involved that they eventually refunded it.

Would NEVER buy anything off them and feel quite happy warning you about them.

BTW - Hi everybody, sorry to storm in with a tirade of abuse! I do love to make an entrance.

Anyone selling anything in the uk via a website is obliged to adhere to OFT distance selling regs.

The Office of Fair Trading: Distance Selling Regulations

Anyone failing to complete an order within 30 days is in breach and you are entitled to a full and immediate refund:

How long do I have to carry out the contract?
3.16 A contract must be carried out within the time limits agreed with the
consumer as stated in your terms and conditions. If no period has
been agreed, the statutory time limit is 30 days from the day after
the day the consumer sends the order to you.

I wouldn't even bother talking to them, just inform your bank that you never received the goods and they are obliged to refund you and chase the retailer for the monies.

Hope this helps,

ali

Yep I agree with that, I've had that kind of thing happen to me a couple of times (not with e-moto though). and each time all i had to do was call my credit card and fill out a simple form that they sent, and haypreso money refunded.

I waited over 2 months for an order. They kept saying it was in their warehouse waiting to be processed and it will be with me within a week.It never did.
You phone them back and they make up some other lie to tide you over.
Contradicting what they had said on previous conversations.
You can't cancel as they call it a special order and they say there is no time limit.
Go elsewhere.

I am pleased for you that you have had satisfaction from eMoto, and all the other folk who have had satisfaction. Because clearly if every one was unhappy with eMoto they would not still be in business.

But, there does exist a huge weight of responses to the subject of eMoto that are uncomplimentary and have been so for a number of years. Not just on this platform but on many Ducati and MV forums globally.

Ipso facto - it is clear from those responses that they do not place "Customer Service" very high on their trading agenda, or pay little heed to the UK's OFT's "Distance Selling Regulations".

Both of these should signal to any potential buyer that you should exercise great caution when purchasing product from eMoto.

Caveat emptor: Buyer Beware.

Oh well, I have got things rolling and even have a case number with Trading standards !

They basically said the same thing about the Distance Selling Act, so they told me to put my gripe in writing and post it recorded delivery to the seller. Did that yesterday so we'll see where it goes.

Couple of lessons learnt.

1. When you order from smaller retailers have a chat with them before hand.
2. Pay on your credit card as you have protection on something like 10 - 30000 quid or something like that. I just use my debit card cos I can't be arsed to transfer money all the time to the CC, also CC charges **** me off... although I have at least found one reason to pay it now.

Apart from people having bad service I think the biggest issue is the way eMoto deal with customers. Bad enough to mess someone around with their order but then to be rude to them when they get upset ?!!... Left me at a loss for words...

Here we go again - I do try really hard not to bag eMuppetto, but I just can't help myself!

They are a bunch of rude, lieing, theiving, charlatans. I'll bet money that even the gypsies in the layby up the road, wont have anything to do with them, they're so disreputable (not the gypsies)!

I ordered goods from eMonkey's last July, suprise suprise, never received anything. When I rang, I was told that goods had been sent to me on one date (never received), rang again & was told that they had been sent on a different date. Rang third time & they offered to resend the goods or give me a refund without even checking with the courier - you just don't do that, so they had obviously never sent them at all.

I accepted the offer of a refund & suddenly the tone changed - you'd have thought that I'd been caught inflagrante with his ol' lady! Told me that they had refunded my debit card whilst I was on the phone - didn't happen. Called again, said that they would now refund my debit card - nope. Emailed them this time & they told me that they hadn't been able to refund my card, so could they have the details of another card I held - YEAH RIGHT!

Called again and asked to speak to the owner: "he's not here", may I speak with someone in accounts "there's no one there either", asked for the name of the owner so that I could write to him: "who are you then?", told the chap on the phone my name:"oh yeah, we know all about you!", so may I have the bosses name? At which point someone who I can only presume to be the owner came on the line, point blank refused to give me his name (& I asked politely at least 4 times), but he was gracious enough to be verbally insulting & abusive before telling me that: "he had better things to do with his time than deal with people like me!" and hanging up.

Finally received a reund by cheque after about 10 weeks & plenty of verbal

The lesson to be learnt is:

Avoid eMoto like an Ebola riddled corpse

Amazes me in this day and age of consumer protection, that people like the Trading Standards can't just enforce a close down order on companies that behave like this, and why dont the banks who have to refund their customers all the time simply refuse to allow these sort of dealers a credit card facility? without that they cannot operate.

Oh well, still haven't heard a thing from eMoto.

Trading standards told me to allow 10 days (I presume working days) so that will be Wednesday this week. Will call em again and see what they have to say. It really looks like I will receive nothing i.e. no parts or refund !...

Your other option is to issue a County Court claim which you can do very easily on line. You can claim back the modest court cost of doing this, (though not legal fees - just do it yourself) and if the facts you have stated here are correct you will have an excellent chance of success. Most companies attacked in this way will simply pay up as the hassle of defending outweighs the cost of refunding you plus your costs.

I tend to find that it is useful to fill in the county court forms, then fax them to the company in default stating that they have 48 hours to refund you failing which proceedings will be issued without further notice. Don't waste your time with complaints and calls - just take the initiative.

(I should add I trained as a lawyer and used to advise people on this sort of thing for the CAB - it is perfectly easy for a layman to do).

If you go to court and win as you 99.999999% certainly will I believe you can also claim interest on the amount owed, best of luck with whatever action you decide on.
