It'd be nice if the Ducati dealer on inspection finds that the only replacement fairings they have for your scratched ones are cf beauties and that the internals of your shocks suffered irreversible trauma and need to be replaced with Ohlins beauties and that your leathers, boots and lid are mus stained and as such written off and replaced with Dainese/Alpine Stars and that you suffered untold mental trauma and need a few weeks off work to recuperate and that there is a really good physio and psycologist in Phillip Island Oz in three weeks time........ Would be great IMO.....

Unhappy

Sue the mama FUNKY, at least he gave you his insurance details, tonight my brothers car got trashed by a drink driver who pegged it from the scene before you could say 'boo to a goose'!!!!! The car was registered to the previous keeper.....police did'nt bother brushing the car for prints or anything, just said to my bro that there is not much they can do. Surprize surprize, what the f**k is this country gonna be like in 5yrs?

Anyway on a lighter note....nice set of wheels my man

.........many years ago a good friend of mine got hit by a car on a pedestrian crossing. No real injuries to him or his girlfriend who was also hit, but of course they went for compensation...his girlfriend settled for the first amount offered, a couple of grand. But my friend decided to stick it out and went to see his doctor and then a shrink, who he told that, due to the trauma of the accident, he was now no longer able to sleep with his gorgeous girlfriend in the missionary position (THIS IS TRUE!!!!!!)
Of course, nobody could disprove it (...apart from his girlfriend...) so, although it took a couple of years of wrangling, he won some serious money in compensation!!!!
Bearing in mind your plum-tank-interface, this may be worth considering!!!!!!
Good luck and, as they used to say at school, 'Non carburundum illigitimum' !

Magoo didnt give me his insurance, only his address..The solicitors are currently trying to find his insurers!! I sent them (lawyers) an absolute stack of pics from the scene and details of my injuries (mostly sprains and a couple of trapped nerves), and all the details of my apparel..They werent impressed with him hitting me around the head!
At the mo, i have a repair company (4th Dimension) and a hire company who are going to give me another bike whilst mine is off the road..Just waiting for the legal dept.
My biggest concern is with the magnesium wheels..Ive asked about and mine are electro plated (not paint or powder coat) to give an almost anodised appearance..this is v.expensive and the wheels in this finish are over £2000 a pair!!
Repairers say the wheels and frame need to measured for irregularities and the wheels x-rayed as they are Mag.
The solicitors are currently putting the case together. Hopefully this will all be done and dusted by Christmas..Ideally i think the old git should be off the road-mostly for showing his utter contempt for any and everybody and his complete lack of acknowledgement for any responsibilty..Im not even suggesting an admission of guilt, confirmation of the potential seriousness would be a start. ******.
A possible outcome is that the 3rd party give me an agreed value in cash less 30% and i keep the bike and repair it. Alternatively they pay for all expenses, (yeah right) or try and wriggle out of it..Lets see?!?

Funky, when the police attended, did they not give Magoo a "producer"? If so, they may have his insurance details. Not sure if they can release them to you though.

That's the bit I don't get. It's an offence to withhold insurance details from someone with just cause to know them. And I would say that, on balance, having nearly been killed, you had just cause.

Unfortunately the solicitors, however well they do, won't get him off the road. I'd be pressing plod to ask why he wasn't being done for DCA.

In response to Nedludd and Steve, at the time of the accident, the old git said he couldnt remember his Insurance details so Plod warned him about withholding his name and address. As regards pressing for a Due Care or reckless driving i think i'll have to take advice from the solicitors. Meanwhile, Ive been online and taken screen grabs and links for some of the prices of my bike gear. With the exception of my lid theres hardly a mark on my gear, but im still going to claim for everything. Im also going to research the possibility of requesting that he takes a visual field test, that should stir things up a bit.

If your lid hit the deck in any way shape or form, it's scrap. And you have got whiplash & emotional damage haven't you?

Ooh yeah. Good call. But isn't he just going to claim that he was wearing his specs, even if he wasn't? Or if he hasn't got them but knows he'd fail a test, just go out and buy some?
