funky, I had a case against me where a bloke wanted me to pay £12 for a broken mirror glass. No proof it was me but I offered to pay outside the insurers without admitting liability. He wanted to go through insurers to make me lose my ncb...

Anyway, I learned that it costs about £1K just to attend court. On top of that, you have the cost of preparing a case and if you lose, you get to pay the other sides costs. You've got a strong case, so the chances of the other side having to pay out more than the 25% liability are high. They may be inclined to talk again.

I don't know about still reading it, i've just read 10 pages

From experience - I had someone pull out from the kerb into the side of my car a few years ago without indicating, an old coffin dodger, mind, i'm nearly there now. He contested what happened saying I was racing to work, which I wasn't, I do flexy, then they offered 50/50 which I declined and after 18 months they decided we'd go to court.

So I met my solicitor and advised him what happened, and he said we had to be careful because the judge we had today quite often found in favour of (I can't remember which he said as it was a while ago now, old duffer/defendant, something like that)

Anyway, there was I, green as can be, first time in a court totally reliant on my brief, and I have to say I have never been so disappointed in someone in my life. I sat next to him thinking 'he's going to challenge this soon' 'he's going to say x or y or z' but nothing. Before I could realise what was going on we was sat outside and he was saying 'well, you can appeal against the decision if you want' yeah right and use you as my brief, I don't think so.

Just be careful, I learnt from experience, it's a tough call, take 75% or risk it ???
But if you do go to court, don't be afraid to speak up !

From my last experience solicitors and insurers are ****s.
Solicitors was a firm in Aldershot (?) and total fecking wimps appointed via Ducati Insurance
T'other guys insurers was the ones that have the red phone on the telly advert - another bunch of ****s who argued a 50% reduction in mileage claim - how the **** did the solicitor agree to that!?! The ****ing mileage was to get to hospital visits and back.

Hey folks quick update...I got a letter a couple of weeks ago from my solicitors saying that they advise making a 'part36' offer. this is an out of court liability settlement. They have suggested Magoo takes 90%. Weve forwarded this to his insurance but as yet no reply. If they reject we have the court option (always a risk), or re-negotiating, (which means i will have to accept more liability which will affect my ncb)..
Anyway, if there are developments I'll re-post!

ive been here and heard a quote that was fairly relevent in that you have to be in court to settle out of court........ie whilst court proceedings arnt set they will take the psss, once court is instigated youd be suprised how quickly things move.................of course you need to be happy with the fact that they are completely to blame
