Mr.Magoo wipes out my 916!!

So im minding my own business riding along the A6006 out of Melton to Notts...Then wot happens next..? Well Mr.Magoo in his 4x4 pulls out front from the right hand side to join the main road and drive in the same direction as your hapless Ducatisti..he hesitates (im now braking and sitting upright)...moves to the centre of the road..(but still hasnt even started steering!! so is perpendicular to the road!!), then goes for it..swan-necking right across my lane...Now my back wheel is 3ft in the air, my spuds are on the tank and my eyeballs are on the inside of my visor..I release the brake, back wheel down..but Mr. Magoo is so far over that i cant even squeeze between his 4x4 and the verge..my right arm hits the rear left of his car and so the inevitable happens...im now officially off roading.. as i trail through the brambles i notice the front going curiously light , then i realise 'ive got air' (as the skating parlance goes)...yeah..im now going down into a ditch!!! "fetch me my brown leathers mister boswain".....
The best of it is as i clamber out of the bitch err ditch with twigs and mud all my Ben Bostrums, Magoo is contemplating a drive off!! When he gets out of the car i see he's about 96!!! We part-take in a little heating verbal intercourse and he refuses to give me his particulars and prepares to alight...as i try to liberate his keys from the ignition he starts hitting me around the head..(Ive still got me Arai on obviously!!)..key does a Uri Geller in the ignition...I have witnesses (bikers!! yipee!), and another guy witness Magoo having a pop at me and calls for Plod. Bottom line...? We pull the bike out of the ditch and...theres hardly a mark on it!! Broken indicator, a few scratches, one gouge on the RH lower panel and some scratches on my lovely magnesium Marchesinis...How lucky was I?? I could soooo easily have been brown bread or at least got a few air miles..The Police (who were excellent I have to admit) made him cough his insurance details so come Monday morning.....
Im must surely win the claim...? He was pulling onto the main road..The witness behind me said i wasnt speeding and i have photos..Old Bill thought Magoo was a total liabilty..He even pulled into an oncoming car when they released him!!
Any thoughts about what i should claim for..? My lid (Arai RX7 Edwards) has a cracked rear vent, scratched visor..some scuffs on my boots and a toe slider ripped off, brown stain on rear of leathers and on suede seat, the scratches and gouge on RH fairing, a tiny dink in the tank, indicator, and those scratches on the mag wheels..Riding home everthing else fine..no vibes or pulling etc..Your thoughts, comments and advice please!!

Oh..heres a pic i took of the bike literally 20 minutes before my altercation....Is it silly to actually feel something akin to love for this lump of metal and plastic..?

Hi Funky,

Here we go again then - old git strikes and he decides the best thing to do is 'ave a go at you

I'm in the motortrade and we use a company called Accident Exchange - if you like I'll PM the tel number to you when I get to work on Monday - they do the lot, claim for you, kick the other Guy, compensate any losses you've had...all I've had is praise from my customers !!!

Give me a shout if you want the details.

Again, i'd claim for every last little scratch on the bike and kit. To be honest forget insurance i'd sue him especially as he laid his hands on you {assault!}, how did he know you wern't injured he could have added to it. I've successfully sued 2 drivers after "incidents". Take him to the cleaners and teach him that he can't can't behave that way OAP or not.

Sue the ******* for all he has......he SAW you coming, THOUGHT about it then DELIBERATELY pulled out.....that is not an accident, or negligence, that is a calculated decision process, and when it went wrong he wanted YOU to accept responsibility and attacked you........not only does the old arsewipe deserve to be off the road forever, but he deserves a prison sentence too for the assault on you both whilst on and off your bike. I had a similar incident once, and I was in a car ffs.....the old **** admitted liability, but then he told me he was registered blind and had had his licence taken away ! When I went to see him later to get the letter he agreed to write admitting liability, he and his mrs had decided they would deny all knowledge of the accident.....it took 2 years to sort out and in the end I had to sue him for the damage to my car, as he was uninsured.....what did the Police do? I'll give you one guess.......

Only one answer to that from me (and, I suspect from everyone here). No. Entirely flippin normal.

Btw, was your attacker wearing glasses? If his eyesight does not meet the standard required, it would help your case.

Yep, take the sh1te to the cleaners. Glad not worse, I'd have felt like breaking his wizened old fingers one by one, the ****. That sort of crap really ****es me off, and I know I'm not alone! Good luck with the claim

Get your Duke to an official dealer that you trust and get a full assessment carried out - make sure your frame, forks, wheels are all straight. Claim for everything from his insurance, including all your clothing, helmet, and boots.
You shouldn't use the bike until it's repaired - hire one and claim for those costs as well. For all you know the frame could be bent or fractured and lead to another accident. Let the dealers get a bill together for the insurance. Once they agree the claim then get it repaired, don't forget the dealers can charge the insurance for storage costs, also let the other parties insurance go to the dealership to assess it.

I would also take action against the third party as others have suggested, he may kill the next biker he pulls out on, or worse still a whole family in a car. You should get down to A & E for a check over tonight and keep details of times, who you see etc.

No doubt you'll ache tomorrow. I got wiped out some years back, felt fine that day, couldn't even walk up the stairs the following day!
Take him to the cleaners and good luck on getting the bike fixed.

I had a similar experience in a car 20 odd yr ago, guy pulled out in front, i swerved to miss him, lost rear/collected rear/lost rear/thru hedge/flipped car/rolled 4 times!! I scrambled out of it not a scratch!! Farmer saw the whole thing, said other chap pulled out in front of me! Hooray! He insisted plod came to scene, thought ok - til it turned out he was off duty plod! They measurd skid - oh speeding where we young fella?? 85mph in a 50!! tut tut! You claim off him, we do you for wreckless - now what you want to do? Fekkers!!
Me ma's car was totalled!
People used to call at the house to see the remains of the car - they said 'you could post that thru a letterbox!!'

Insult to injury - the car was Fully Comp but also 13 mnths old had it been uinder 12 mnths we'd have got it replaced as it was mum only got book value which as we all know is NOWHERE near the value of the vehicle lost!!
