Insurance Warning

I recently had occassion to make a claim on my insurance following a burglary when my 1992 CBR900rrn was stolen. The bike was secured in my garage,alarmed and insured fully comp. tax was valid but the MOT was expired Nov 06.
According to my insurance company i should have notified DVLA via SORN that the vehicle was off the road. As i hadnt done this they are at present declining to pay anything to compensate the theft.
I have tried to point out the error of their thought processes in that SORN only relates to vehicle excise and not MOT certification but the ****s dont believe me.The supervisor even had the neck to claim it was a DVLA instruction. I bet the knob wouldnt know a motorbike if it bit them on the arse. They even suggested i was using it on the road.(not true i am after all a law abiding citizen that taxes and insures his bikes even though theyre off the road)
I am not naming the company yet as this is ongoing but its advertised in most motorcycle papers/mags and you can be assured that the issue will be shouted to anyone who will listen.
An official letter from DVLA is winging its way to them as we speak. watch this space ....it may get even more ...sorry the red mist is coming down..must hit something..take my 999 keys off me and hide me boots

That sucks - hope you get them to cough up - you should name and shame them - on the bright side at least it wasn't the duke that went walkabout....fingers crossed that common sense prevails.

mate had his S4 Audi nicked and used in an armed kidnaping in which the local fuzz woke him to tell him his car was a) nicked b) had to be rammed off the road and had sustained a little damage ie fecked !! Turned out he had no MOT either by some 3 months but they still paid out and it was £6k worth of damage!

They are trying it on! Keep ragging em or try legal advice/letters

They will do anything to get out of paying out the ******** what does not having tax and an MoT have anything to do with the bike bieng stolen if thins is the case then maybe there should be a warning when you SORN a vehicle that it will not be insured when a vehicle is not Taxed or MoT'ed

Have you contacted a solicitor yet?

Like I said on another thread, insurers will try and worm out of paying up with any slight loophole they can find. As to the SORN business, I thought if you hadn't taxed your vehicle and not declared SORN either, the DVLA fined you these days.

On the other hand, I wrote off a virtually brand new TL1000S in a serious accident in 2002. My insurance company couldn't have been more helpful, paying up virtually the full purchase price of the bike (less excess of course) and almost the full replacement values of leathers and lid (a £500 Arai).

The company was (and still is) Carole Nash, if anyone wants to know.

Conversation with Insurance company
"Oh it says in our policy that your mororcyle must have a current MOT".
"Oh no it doesnt it says "where required by law". That means if i use the bike on a public road, i am not.
"Well you might just be saying that how do we know that you are not using "it.
You **** (thats what went through my mind)
I bought your product believing it would cover me if my motorcyle was stolen. I would think most of your customers believe the same perhaps they should be enlightened.
We have considered the issue and at this time we are going to honour the claim minus 10% as you have no MOT"
"I dont need an MOT (repeat above paragraph 3 more times).
When will i get the cheque?
"Ill do it today"
What is the address of your Ombudsman?

Because your a **** and i need to tell someone in authority!!!!

Well if nothing else its a start - just make sure if you do want to take it further that the cheque isn't issued on the basis of "Full and Final Settlement" of claim.

Update
Just had a cheque for £1795 minus £,400 EXCESS MINUS 10% No valid MOT.Grand total for my loss £1395. Vultures!!
There was no mention of "full and final settlement in the letter so i intend to bank the cheque and take on ZENITH insurance for miselling insurance.My arguement being that according to the policy schedule i was covered as long as the motorcycle was garaged taxed and had an MOT "where required by law". the lawi.e construction and Use and RTA 1972 etc doesnt apply to a 20' x 12' garage which is off the public road.
I wonder how many of us have had a second bike "insured" and taxed in our garage over the winter believing it was covered for loss? And dont forget according to ZENITH you need to notify DVLA that the bike is off road. Please check your cover. Meanwhile the loss of the CBR will be made slightly less gutting when i spend the payout on the Febbre Gialla999s, and a better insurance policy! FG
