Insurance Company Not Paying Out for my 749S!

HI EVERYONE AS YOU MAY NO I ASKED EVERYONE TO KEEP AN EYE OPEN FOR MY 749S MONSTER MOB AS IT WAS STOLEN ON 13/09/2006. THE INSURANCE PEOPLE ARE NOW REFUSING TO PAY BECAUSE THEY NEVER GOT A LETTER IN THE POST ABOUT MY DETAILS (ban & DD40)WHAT A LOAD OF ???? THEY ARE ALSO SAYING I DID`NT INFORM THEM ABOUT IT BEING A GENUINE MONSTER MOB BUT IT STATE ON THE INSURANCE FORM IS THERE ANY MODIFICATION FROM THE MANUFACTURES SPEC SO I SAID NO ITS NOT MODIFYED DUCATI MADE IT AND ITS ONLY THE PAINT WORK WHICH IS DIFFERENT SO ITS A 749 S.
CAN ANYONE GIVE ME INFO ON WERE I STAND ACCESS UNDERWRITING WAS THE BROKER WHO HAS BEEN A TOTAL WASTE OF TIME

Regarding the modified part.....

Your best of first writting to Ducati UK and getting them to send you a letter stating that the bike you purchased was a ltd edt straight from the factory....
Your argument will be that you have not modified it but you need to prove this....

Regarding the ban and DD40, was the insurance running at the time you recieved these or did you fail to notify them at the time of purchasing the insurance cover....??

You are required to notify the insurance if you receive any endorsements/bans prior to application and during any period of cover....

If the bike was stolen prior to your DD40 and ban then your arguement would be that you did not have the insured bike to ride and that you the offences you committed happened after the bike was stolen.....??

You will need to be a little clearer on when the offences occured..??

Getting back to the paint job/ltd edition thingy.......it is important that you approach Ducati UK for that supporting letter.......so I would get on to them asap..
Does your V5 state that your bike is something like Ducati 'MonsterMob'..??

I would also suggest a consultation with a solicitor as they will be able to advise you to where you stand in this matter......!!

At then end of the day, if you have not withheld any information or fabricated anything then you should be fine.........these insurance people will do anything not to pay out...so it's up to you to fight them at their own game......sad but true..

WHEN TOOK OUT INSURANCE THEY SENT FORM OUT IS EVERTHING OK IF NOT RETURN IT TO US WITH THE INFO SO I DID THEY GOT THE PART ABOUT CARRYIN PASSENGERS BUT NOT ABOUT THE BAN & DD40 WHICH WAS ON THE SAME FORM THEY STATE NEVER GOT IT (BROKER) THEY ALSO ON ANOTHER OCCATION NEVER GOT MY NO-CLAIMS WHICH WAS IN WITH OTHER PAPERWORK AND SENT RECORDED GOT EVERYTHING ELSE BUT THAT.THEY ARE A JOKE

When you completed the initial application (normally by phone) did you state to them then that you had a ban+DD40..because if you did, most companies will have recorded the conversation for your protection and theirs...if this is the case then you can request a copy of this via the Data protection/freedom of information act...

If you dropped in personally to a broker you can also request to see the original application under the same request.....

Regarding the lost no claims cert...that could have been easily rectified by you contacting your previous insurance to request another 'proof of no claims certificate'.......??

Did you make copies..??

When it come to insurance you need to cover your ar*e for every eventuality because it's easy for

1)You to say "But I sent it to you"

2) For them to say "We did not receive it"

If as you state the amended paperwork was with the cert of no claims and that it was sent recorded, why would they only get the bit about 'carrying passengers'...???

Seems strange to me as it would do to a small claims court if you was to attempt to take your broker to one..

Dont get me wrong, I know mistakes happen, paperwork goes astray, people inadvertantly forget to make mention of things......but at the end of the day...it's now up to you to prove that you notified your insurance of these outstanding issues which have been raised......!!

I just hope for your sake that having gone through the anguish of having your pride and joy stolen, you can prove via copies or similar that your broker has made the mistake and not you.....

I do really wish you good luck buddy......I plus many others have seen the lengths that you have gone to to try and recover your bike (eBay, local Papers etc..) lets just hope theres a light at the end of the tunnel......

I APPYED BY INTERNET WHICH ENDED UP CRASHIN BUT THEY HAD MOST OF MY DETAILS WHEN I RANG THEM THE PERSON WHO I SPOKE TO DENIES SPEEKING TO ME SO I SAID HOW DO I NO YA NAME ITS BIN A BIG JOKE FROM DAY 1 I WILL BE SEEKING LEGAL ADVISE BUT I DONT THINK IT WILL BE GOOD NEWS

Get all your paperwork together including any correspondence from the broker and speak to a solicitor buddy......

They will be able to tell you if you have a case or not......and the likely hood is..you have....!

In the mean time...dont give up....and as a good friend of mine once told me.....

I'm always on the hunt for Ducati 749/999 spares so be assured I'm always looking out for any bits that might have come from you bike buddy....if I find anyone attempting to sell any, you'll be the first to know.......theiving sc*mbags...!! :wink:

I know first hand how insurance companies try to get out of paying out Jet.

I had a non fault accident in July 02 when I was hit by a bus whilst stationary at a junction,

The driver admitted liability in front of a chap who was my witness, gave me his driver number and the phone number of the person to contact,

I contacted the bus company, then my insurers who told me to get my bike to Riverside Motorcycles and being Fully Comp it would be completed within a week or 2. It took 3 months

Then I recieved this letter from MY insurers.

I sent them a letter stating that I had bought the bike from a friend but did'nt know it was not standard as I seen many Dukes in bike shops and as this was my first ever Duke that it was standard. ( Pleaded ignorant) and they swallowed it and repaired my bike, But only with standard parts.

As for the Ban an DD40 I hope you get that sorted mate.

They're are such a bunch of mofos, but unfortunately there is a statute that says you must disclose all info, so instantly they have the upper hand.

Legal advice is the only way old chap.

Interesting letter Duke996special.

Looking at that list of non-standard parts I think it reflects pretty well on them that they paid out. I'm sure plenty of other underwriters would have jumped on the opportunity not to. (Just a thought, but d'you want to edit that letter so that your home address and presumably location of nice Duc isn't all over the net?)

thanks to everyone for the info i no i don`t have a leg to stand on when it comes to them payin out but i will try my hardest i even have GAP insurance but that wont pay out if the orginal insurance wont .its all been a waste of money. i wonder if they dont pay out can i have my money back for insurance i`ve not had lol
i will be contacting leagal advise just hope they can help
